Dear Customer,
When you place an order, either through our website, by telephone or otherwise, you confirm your agreement to our terms and conditions. Iberica Ltd wants you to be completely happy with your purchase so we have tried to be as fair and clear as we can so you know what to expect.
Definitions. www.goodspanishfood.com ("our site") is a site operated by Iberica Ltd, referred as "we", "us", "our". Customers are referred to as "you" or "your".
INTRODUCTION
This introduction is simply meant to give you an overview of the terms and conditions referred to in your order.
They describe the terms under which we sell the goods to you. In particular, we aim to deliver the correct goods to the right place at the agreed time in perfect condition, and they explain our legal responsibility to you if we fail to meet these standards.
They explain that you must pay us the correct price, and that legal ownership of the goods does not pass from us to you until that time.
ORDERS
Orders to which these terms and conditions apply may only be placed by individual customers (Wholesale customers should contact us direct).
All orders for products shall be deemed to be an offer by you, the buyer, to purchase products pursuant to these terms and conditions.
You, the buyer, shall be responsible for ensuring the accuracy of the details provided on the order form/over the telephone and we will not be obliged to accept an order unless all details requested have been entered correctly.
No order submitted by you, the buyer, shall be deemed to be accepted by us unless and until we confirm acceptance of your order by sending a shipping confirmation e-mail.
PLACING AN ORDER
After submitting your order, we will send you an order confirmation email with our identity and contact details, shown as Iberica Ltd., your order number, details of the product(s) you have ordered from us, the total price payable (including any applicable taxes and delivery charges) and delivery details. Please note that the confirmation email is an acknowledgement that we have received your order and is not an acceptance of the order. Once the order has been processed, a shipping confirmation email will be sent with tracking information and shipping address.
We reserve the right not to accept any order placed by you and will not be required to provide an explanation. For example, due to one or more of the following:
- The product is out of stock
- Payment has not being authorised
- Error in pricing or product description
- The age restrictions for orders containing alcohol or knives are not being met.
- Technical failure of the website
PRODUCTS
At Iberica Ltd we make every effort to represent our products as accurately as possible to our customers, so you can make the best purchasing decisions possible. However, certain aspects of product description will always be subjective. Please note the below disclaimer:
- Name: Product names for international foods can be complex. Although we try our best to translate the product name into English, it might contain Spanish words and slightly differ from the original
- Imagery: Images are strictly representative and the product you receive might look different from the one pictured on our website
- Weight: The content size of a product will, unless specified, be the total weight and not the drained weight. Any reference to approximate weights is a guide as all the items on our website are sold on a 'per unit' basis
- Ingredients: In cases where ingredients are not correctly specified on the product description, we will be happy to provide a return/refund should the product no longer be acceptable to you on the grounds of "product not as described"
PRODUCT AVAILABILITY
All items are typically in stock unless “Sold Out” is displayed. Please be aware that even if an item is in your shopping cart, it can still be bought by another customer until you have completed your order.
If the product is out of stock, please feel free to contact us to find out if there is a waiting list for that item or when it might be back in stock.
PRICES
All prices displayed on our website are shown in pound sterling (£) and are inclusive of UK VAT at the current rate unless clearly stated otherwise. Prices published on www.goodspanishfood.com may change without notice. Products which are not priced are not currently available and orders placed for these products will be cancelled without notice.
ORDERS CONTAINING ALCOHOL
It is prohibited by law to sell alcohol to anyone under the age of 18. Iberica ltd will not sell alcohol to anyone under the age of 18. By placing an order with us you confirm that you are at least 18 years old, or in the case of the order containing alcohol being a gift you also confirm that the recipient is 18 or over. You also confirm that the information that you give is correct and truthful. Upon delivery, an adult over the age of 18 will be required to sign for delivery.
PAYMENT
When we provide any products to you, the buyer, under these terms and conditions, payment will be charged to the credit card account provided by you on the website order form/over the telephone.
By placing an order, you, the buyer, consent to payment being charged to your credit card account as provided.
Next, we will send you an electronic receipt to your email address with details of the product, an order number, and delivery details, including any tracking information. We will send you a further email once the products have been dispatched.
You, the buyer, will own the goods once they have been delivered to the address specified and when we have received cleared payment for the goods in full. Until that time we will retain title to the goods.
It is your responsibility to ensure all the order details you give us are correct as we are unable to redirect orders once we have despatched them.
If your bank or card issuer does not authorise payment to us, we cannot be liable for any delay or non-delivery.
CANCELLATION
To cancel your order, simply complete our contact form or call us on 01273 59 02 82 during office hours up to 10am the day before delivery. If cancelling this late, please do so by phone. If you cancel your order after the goods have been shipped to you, please notify us, and do not accept receipt of the goods. On return, if the items are not perishable and haven’t been affected,we will refund the order to your credit card excluding shipping costs. Refunds will be processed as soon as possible, in any case, not later than 10 days from the date on which you gave notice of your cancellation.
SUBSTITUTION
In cases of stockouts, we are entitled to substitute any item in your order with an item of the same or higher value of the same or very similar product.
YOUR WARRANTY
You, the buyer, warrant that all details provided on the order form/over the telephone for the purpose of purchasing the products are correct, that the credit card you are using is your own or you have the owner’s authorisation to use it, and that there are sufficient funds and/or sufficient unused credit available to cover the cost of the products.
LIMITATION OF LIABILITY
We will use all reasonable endeavours to carry out our obligations within a reasonable period of time but will not be liable to you, the buyer for any loss, costs or expenses arising directly or indirectly from any delays in doing so and we will not be deemed to be in breach of these terms by reason of any delay in performing, or any failure to perform, any of our obligations in relation to these terms, if the delay or failure was due to any cause beyond our reasonable control, including but not limited to:
- Act of God, explosion, flood, tempest, fire or accident;
- War or threat of war, sabotage, terrorism, civil disturbance or requisition;
- Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;
- Import or export regulations or embargoes;
- Strikes, lock outs or other industrial actions or trade disputes;
- Difficulties in obtaining raw materials, labour, fuel, parts or machinery;
- Power failure or breakdown in machinery;
- Being let down by suppliers or sub-contractors
If we are prevented from carrying out our obligations in the above circumstances, we will notify you in writing. If we are still prevented from carrying out our obligations 3 weeks from the date such notice was sent, then we may give written notice to you cancelling the contract. If the contract is cancelled in this way we accept no liability to compensate you for any loss or damage caused by failure to perform.
Except where you, the buyer are dealing as consumer (as defined in the Unfair Contract Terms Act 1977 section 12 as amended) we do not give any warranty, guarantee or indemnity as to quality, fitness for purpose or otherwise of the products.
Except in respect of death or personal injury caused by our negligence or any other matter that the law says we can’t exclude, we will not be liable to you, the buyer, for any loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims, which arise out of or in connection with the supply of products and our total legal responsibility to you under the contract will not exceed the price of the goods.
WEBSITE
We will attempt to ensure that the information available on the website at any time is accurate. However, we will not be held liable for any errors or omissions. We will use all reasonable endeavours to correct errors and omissions as quickly as practicable after becoming aware or being notified of these.
We promise that the goods will conform in all material respects to their description, be of high quality and free from significant defects. However, all photographs, descriptive matter and specifications of the products on the website, or statements we’ve otherwise communicated to you, are for the sole purpose of giving an approximate description of the products and do not form part of the contract.
We may also change, suspend or discontinue any aspect of the website, including the availability of any features, information, database or content or restrict access to parts or all of the website without notice or liability.
GENERAL TERMS
We reserve the right to change these Terms and Conditions at any time. Any such changes will take effect from when they are posted on our website and it is your responsibility to read the Terms and conditions on each occasion that you use our site. Your continued use of www.goodspanishfood.com or its functionality shall signify your acceptance to be bound by the latest Terms and Conditions.
If any provision or part of one of our terms and conditions is determined to be invalid or unenforceable the rest of the terms will still apply. Delay in exercising a right under these terms will not take away that or any other right. Changes to the contract are only binding if we agree them in writing. Nobody other than we and you may rely on any terms of this contract.
We will only use the personal information you provide to us to supply the products to you, to process your payment for the products; and, if you agreed to this during the order process, to give you information about similar products that we provide, but you may stop receiving this at any time by contacting us.
English Law will apply to these terms and conditions and only the courts of England have a right to deal with any disputes arising from them.
It is Your Responsibility to:
